Trial Scheduled for Man Who Escaped from Courthouse During Last Murder Trial

A murder suspect who walked away from the Bexar County Courthouse moments before jury selection was set to begin nearly a year ago, is scheduled for trial Monday.

On August 25, 2015, Jose Gutierrez requested to leave the courtroom right before the trial began to tell family members that they could watch jury selection. However, he quickly disappeared, eluding authorities for nearly a month., according to a U.S. Marshals news release.

Investigators later found Gutierrez's electronic ankle monitor, which had been cut off, at a McDonald's near Interstate 35 and North Walters, according the news release.

On September 15, U.S. Marshals arrested Gutierrez at a house on the West Side where he was hiding.

Gutierrez is accused of shooting 31-year-old Raul Garcia multiple times on the 11700 block of Kinney Road on August 30, 2013.

Gutierrez faces multiple other charges, including theft charges, retaliation, trespassing, discharging a firearm, burglary and resisting and evading arrest, court documents show.
