San Antonio Police Chief Anthony Treviño said today that the department's administrative review of a police shooting that left a 23-year-old man dead last February has been completed and turned over to the District Attorney's Office.
"Officer (Robert) Encina is still on administrative duty and waiting the outcome from the DA's office," Treviño said.
Encina shot and killed Marquise Jones on February 28 in 2014. The San Antonio Police Department has said Jones pulled a gun on Encina, who was off duty and working security at Chacho's and Chalucci's, after the officer investigated a fender bender at the restaurant. Jones was a passenger in one of the vehicles involved in the minor accident.
His aunt, Deborah Jones Bush, said the family last spoke to District Attorney Nico LaHood about a month and a half ago, but left without answers as to whether a grand jury would convene to hear the case.
Jones' family disputes the SAPD's version of events, pointing to an autopsy that showed Jones was shot in the back. Bush alleges the gun police say Jones pulled on Encina was found 20 feet away from him and didn't have any fingerprints on it.
On Saturday, supporters of Jones and his family will rally in front of the District Attorney's Office and call for an indictment.
