Former SAPD Officer Avoids Rape Conviction, Sentenced to 14 Months

A former San Antonio Police Department patrol officer accused of handcuffing a woman and raping her in the back of his patrol car avoided a conviction for aggravated sexual assault by pleading no contest to improper sexual activity with a person in custody, KENS reports.

Jackie Neal, 42, agreed to a plea deal Monday, and his relatives, who spoke with media at the courtroom, defended the former officer.



Still, his mother and ex-wife said this is not justice. They said Neal is innocent.

"This is wrong, and justice has not been served," said Debby Neal. "An innocent man is going to jail."

The family accuses the victim of seeking money, telling the television station that the sex was consensual. The unidentified victim settled a lawsuit against the city for $500,000 and Neal is required to pay her $2 million as part of a federal judgment, according to the KENS report.

Neal was also accused of a similar violation, but the accuser stopped cooperating and the case was dropped. He also dated an 18-year-old in the police explorers program for which he received a three-day suspension.

In April, Sandra Diaz, who he was dating at the time, shot him in the throat during a domestic dispute. She is charged with aggravated assault with a deadly weapon.
