To the delight of forgiving Texans with a sweet tooth, Blue Bell returned to close out 2015.

The Department of Justice, however, isn't ready to just let bygones be bygones in the wake of a deadly Listeria outbreak last year that killed three people.

CBS News reports that the DOJ has opened an investigation into the company to determine whether it knew about problems in production facilities that resulted in fatalities and illnesses.

Well, we already know they knew. In May, the Centers for Disease Control (CDC) said it was concerned that Blue Bell knew about Listeria problems in its plant as far back as 2010, and only recalled its products in 2015.

The DOJ's Consumer Protection Branch, which investigated the Peanut Corporation of America's management for a 2008-2009 salmonella outbreak that caused mass sickness and nine fatalities, resulting in five executives facing a total of 62 years in prison, is leading the investigation into Blue Bell, according to Food Safety News.
