How to Handle a DWI Traffic Stop by Police

However, if you are out and about and get pulled over, local attorney Linda S. Corley has some tips.

But first, to make it abundantly clear: "The information you obtain on this site is not, nor is it intended to be, legal advice."

First off, if you are pulled over, be respectful.

In a tip sheet, Corley says people should refuse to answer questions and refuse to perform any tests, including eye tests, walk and turn tests, one leg stand tests, ABC tests, counting tests, and don't blow or consent to a blood test. Remember, be firm, but respectful.

The only question you should answer is your who you are and your birthday.

"If you refuse to answer questions and refuse to perform tests, you will likely be arrested and have to bond out of jail," Corley's tip sheet says. "What you don't know is that if you answer questions and perform their tests, you will still likely be arrested and have to bond out of jail anyway; but you will have seriously damaged your defense.

Corley also says in the tip sheet that people should think long-term defense, not short-term attempts to avoid a trip to jail because those typically fail and result in a conviction.
