Opponents of a controversial housing development in Northwest Bexar County say they’re gearing up for court after the Texas Commission on Environmental Quality (TCEQ) last week declined to hear an appeal over the project’s wastewater permit.

On Dec. 26, attorneys representing the Greater Edwards Aquifer Alliance and the City of Grey Forrest confirmed that the TCEQ had turned down an appeal filed by the groups demanding a hearing on the plant needed for Lennar’s 3,000-home Guajolote Ranch development to move forward.

The two organizations filed an appeal after the TCEQ in October OKed a permit allowing Lennar to construct a plant to discharge treated wastewater into Helotes Creek. That approval came despite a 2020 Southwest Research Institute study raising concerns that discharge could “significantly degrade the watershed and the quality of water recharging the Edwards Aquifer.”

Another group opposed to the construction of the wastewater plant, the Scenic Loop-Helotes Creek Alliance, said in a press release that it now plans to bring the matter to district court in Travis County. The organization plans to file its case by the end of January, according to the statement.

So far, Bexar County Commissioners Court, a handful of San Antonio City Council members, former Mayor Ron Nirenberg and State Sen. Donna Campbell, R-New Braunfels, have come out against the construction of the water plant and the broader Guajolote Ranch development.
