San Antonio homeowner wrongly arrested by police last year has sued the city, SAPD and the three officers involved, charging that he was subjected to excessive force and physical injury.
Alex Adam Delgado filed the suit Feb. 7 in Bexar County District Court, alleging a trio of officers came to his house Feb. 24, 2024, to respond to a reported break-in. He argues police forced their way inside even though he was “compliant” and told them no one had called for help.
Delgado’s petition accuses Officer Bless Achor of using excessive force by kicking his leg from underneath him and causing him to fall, at which point officers put him in restraints. The plaintiff said the scuffle left him humiliated, emotionally distressed and suffering from physical injuries, including bruises. City officials said they haven’t yet been served with the lawsuit. “We will review the allegations made, research the facts of the case and will defend the City based on the merits of the case,” the city said in an emailed statement.
Last year, SAPD slapped Achor with a 10-day suspension over Delgado’s arrest, saying the officer violated department use-of-force rules and engaged in conduct “prejudicial to good order.”
The suit says the actions of the officers — who also include Rodriguez Cyrenns and Rogelio Guillen — were “unjustified, excessive, and unlawful, leading to the present lawsuit.” It also alleges the officers defamed Delgado by making false statements about the arrest. Delgado’s petition also accuses the city and SAPD of negligence, saying their failure to “properly screen, train and supervise” personnel led to the incident at the heart of the court case.
