District Court Judge Joel Perez on Tuesday said he needs more time to decide whether to quash part of the indictment against Brad Simpson, the Olmos Park man accused of killing his wife following an argument outside their million-dollar home.

During the hearing, Simpson’s court-appointed attorney, Steven Gilmore, argued that part of the indictment should be thrown out, because without producing a body the state can’t be sure how the defendant’s wife, Suzanne Simpson, died.

State prosecutor Casey Sandoval shot back at that argument.

“We don’t have a benefit of a body for a medical examiner to examine, but that doesn’t prohibit us from filing this case,” Sandoval said.

Judge Perez said he will make a final ruling on April 29 whether to throw out part of the indictment. Even if Judge Perez rules in Brad Simpson’s favor, the state can still refile those charges at a later date, however.

Suzanne Simpson, a real estate agent and mother of four, went missing on Oct. 7 after she and her husband engaged in a heated argument outside their $1.4 million Olmos Park mansion, according to an arrest affidavit. A Bexar County grand jury indicted Brad Simpson for the death of Suzanne Simpson in December.
