A judge ruled Tuesday that he won’t dismiss part of the murder indictment against Brad Simpson, the Olmos Park man accused of killing his real-estate agent wife last year after an argument outside their home, the Express-News reports.
Simpson’s defense asked State District Judge Joel Perez to reject a portion of the indictment, arguing that authorities have yet to locate Suzanne Simpson’s body, which makes it impossible for the state to know how she died. The judge last week said he needed more time to consider the motion.
Perez revealed his final decision Tuesday morning, rejecting the motion while some of Suzanne Simpson’s friends and relatives were in the courtroom, the daily reports.
Suzanne Simpson, a real estate agent and mother of four, went missing on Oct. 7 after she and her husband engaged in a heated argument outside their $1.4 million Olmos Park mansion, according to an arrest affidavit. A Bexar County grand jury indicted Brad Simpson for the death of Suzanne Simpson in December.
The next hearing in the case will take place in 30 days, according to the Express-News.
