
Erik Cantu — the young man shot multiple times by a former San Antonio police officer almost four years ago — was arrested and charged with felony evading arrest at around 9 p.m. Monday night, the Express-News reports.
Cantu’s arrest came mere hours after the Bexar County District Attorney’s Office dismissed its case against James Brennand, the officer fired for shooting Cantu in December 2022.
Police arrested Cantu Monday after responding to a “wanted person” call on the 124000 block of I-10 West, the daily reports, citing police documents.
Cantu reportedly “disobeyed police commands” and then took off on foot before being taken into custody without incident. Police charged him with evading arrest with a previous conviction, a state jail felony, according to the Express-News.
It’s the seventh time authorities have charged Cantu with a crime since 2022.
Monday’s dismissal of the case against Brennand — who fired at Cantu, then an unarmed teen, as he sat in a McDonald’s parking lot — came after prosecutors asked for a continuance due to an ongoing investigation into whether Cantu made a terroristic threat against someone on July 1.
Attorneys representing Brennand argued that another continuance in their client’s case would violate his constitutional right to a speedy trial. The DA’s office dropped the case after 437th District Court Judge Joel Perez denied the request for a continuance.
Even so, officials with the DA’s office said they may refile charges against Brennand at a later date.
