Jason Wolff, an independent candidate running for Bexar County District Attorney, will remain on the November ballot, a judge ruled in a defeat for the county Republican Party.
The ruling comes after the Bexar GOP and Ashley Foster, who’s running for DA as a Republican, sued last month to strike Wolff from the ballot. On Wednesday, 225th Civil District Court Judge Christine Vasquez Hortick ruled that the plaintiffs didn’t provide enough evidence to back up their claim.
“God is good, and God is good all the time,” Wolff said in a TikTok after his court victory.
The lawsuit alleged that Wolff’s notary, Shania Ochoa, accepted petition signatures without requiring the people who circulated the petitions to sign affidavits swearing under oath that they personally collected them.
Roughly half of those individuals swore under oath during the trial that they had signed the petition, thereby legally validating their signatures.
The Bexar County GOP and Foster rested their case before all of the people subpoenaed were called to testify.
“They all took the stand after having waited hours on hard benches, not able to be there for their work, for their families, for their kids, and did exactly what I said they were gonna do,” Wolff said. “They raised their right hand and swore that every one of those signatures were real and correct and accurate.”
During the trial, Bexar County Elections Administrator Michelle Carew, who was also named as a defendant in the lawsuit, said that she had no position other than that the Texas Secretary of State approved Wolff’s petition in July.
In testimony, Carew also warned that removing Wolff from the ballot would delay the election process because the documents would need to be changed at the last minute.
Wolff is running against both Foster, the GOP candidate who sued, and Democrat Luz Elena Chapa in November.
“I’m going to continue to fight the good fight, and thank you to those people who signed my petitions, who were there for me hour after hour, and who continue to fight for me,” Wolff said. “We will win in November.”
Voters can check the Bexar County Elections Department website to confirm they are registered to vote in the Nov. 3 election.
