It’s been two years since San Antonio restaurant chain Fred’s Fish Fry embarked on a legal battle against more than a dozen defendants for their alleged roles in creating and selling a joke sports jersey sporting the company’s logo.

Now, the courtroom saga that captured the attention of chronically online San Antonians may finally be nearing a resolution.

On Monday, U.S. District Judge Xavier Rodriguez agreed that one of the few remaining defendants, Food Truck Park Rancho 181 owner Victor Galvan, wasn’t properly served, voiding an earlier default judgment against him in the case, the Express-News reports.

Galvan has long denied involvement in creating the jersey, which was sold online in 2023 without the business’ permission. Galvan’s employee, Adrian Galvan — no relation — has owned up to creating the design as an online joke but denied that his boss was ever involved.

Indeed, Adrian Galvan told The Current in an earlier conversations that he created the original jersey design as a meme, but added that he never sold or profited off the design. He’s also said that while he worked for Victor Galvan at Rancho 181 at the time, he’s puzzled why his former boss was ever named in the suit.

In the wake of this Rodriguez’s ruling, Fred’s Fish Fry has two weeks to decide whether it wants to proceed with its legal action against Victor Galvan, the Express-News reports.

If the fried-fish merchant decides not move forward with a legal case against Victor Galvan, that means a final judgment will be entered against Adrian Galvan and Michael Baez, owner of online retailer Bexar County Social Apparel, which sold a variation of the jersey on its website for a brief period two years ago.
