SAISD is believed to be the first big Texas school district to make staff vaccinations mandatory.
A San Antonio District Judge denied Texas Attorney General Ken Paxton's request for a temporary order stopping San Antonio ISD from requiring teachers and staff to be vaccinated against COVID-19.
District Court Judge Mary Lou Alvarez denied the injunction Friday following a two-hour hearing, according to a KSAT report. Attorneys for Paxton's office indicated they plan to appeal.Last month, San Antonio ISD became the first district in the state to require vaccinations for its workers, setting an October 15 deadline for them to get inoculated.
Paxton's office has sued twice to stop the rule from going into effect. The AG argues the mandate violates an order issued by Republican Gov. Greg Abbott, who has repeatedly tussled with municipalities around the state over whether they can issue mask mandates or require workers to get vaccinated.
Paxton's office maintains that the governor's disaster declaration over the pandemic allows him to issue rules overriding local authorities. However, Alvarez said the state failed to present evidence that an injunction is necessary, KSAT reports.
The trial over the state's lawsuit to overturn the mandate is scheduled for January 19, well after the deadline for district employees to get their jabs, according to the story.
